Understanding California's Just Cause Eviction Law

California's Just Cause Eviction Law, enacted as part of AB 1482 (Tenant Protection Act of 2019), provides strong protections for tenants by limiting when landlords can legally evict them. 

 

This law applies to most rental properties across the state and aims to prevent unjust displacement of renters.

 

When Does the Law Apply?

 

The Just Cause Eviction law covers tenants who have lived in a rental unit for 12 months or more (or at least one tenant in a shared unit for 24 months). It applies to most residential properties, though some exemptions exist, such as single-family homes owned by individuals (not corporations) and certain newer buildings.

 

What Are Valid Reasons for Eviction?

 

Under this law, landlords must provide a "just cause" reason for eviction, which falls into two categories:

At-Fault Just Cause: This includes tenant violations such as:

 

·       Nonpayment of rent

·       Breach of lease terms

·       Engaging in criminal activity

·       Creating a nuisance or damage to the property

·       No-Fault Just Cause: These occur when a tenant is not at fault, but the landlord has a legitimate reason to reclaim the unit, such as:

·       The owner or their immediate family moving in

·       Substantial renovations requiring vacancy.

·       Removing the unit from the rental market under the Ellis Act

·       Government orders to vacate.

 

Tenant Protection and Relocation Assistance

 

For no-fault evictions, landlords must provide relocation assistance or a rent waiver equal to one month to help displaced tenants transition.
