San Diego to Make it HARDER to Vacate Your Tenant

Thanks to a recent update by the California Apartment Association, we know that the City of San Diego is planning on overhauling its long time “just cause” for eviction rules which apply to renters who have lived in the same rental property for two years.

 

It’s not surprising that the City of San Diego is contemplating this proposal, especially since Covid-19 eviction protections have ended, and the city faces an eviction crisis.

 

How will this move affect landlords? In this we will break down what the city is contemplating so that owners can be prepared for these changes, should they be approved.

 

Right To Know Notice Would Be Repealed

 

Proposed by Mayor Todd Gloria, and City Council President Sean Elo Rivera, this proposal would effectively end the city’s “Right to Know” ordinance and it would give tenants new protections including:

 

·      Just cause eviction would be instituted from Day 1 of a renters stay in a property.

 

·      Require landlords to give their tenants more time to resolve lease violations.

 

·      Landlords would also be required to pay up to three months-worth of rent as ‘relocation assistance’ should they ask their tenant to move because the owner wants to move in, renovate, or take the rental off market.

 

·      In some cases, landlords could also be required to pay for a tenant’s legal counsel or mediation should the landlord move forward with eviction.

 

Landlords Poised to Fight Back

 

There’s no denying that the City of San Diego does have an eviction crisis on its hands, but housing providers should not continue to be penalized for the current condition of the housing market in San Diego.

 

Many housing providers have given up in recent years, and sold their properties, while others continue to struggle financially as they slowly come back financially from months of not collecting rent.
