Breaking News: San Diego's Housing Regulations Set to Expand

The San Diego City Council will be hearing a new tenant protection ordinance today which, if approved, will limit a landlord’s ability to provide quality rental housing to their tenants.

 

This move was expected because the end of Covid-19 tenant protections has resulted in more people ending up on the street and the City Council has been working hard to slow down evictions.

 

What Will the New Tenant Protections Include?

 

·      All renters will have eviction protections from the first day of their tenancy.

 

·      Landlords will face more restrictions on the improvements that they can make to their rental properties.

 

·      If a landlord evicts their tenant, they will be required to pay thousands of dollars in relocation fees.

 

·      Landlords will also be faced with paying additional fines for civil violations including: damages and attorneys’ fees.

 

This in and of itself is not a silver bullet to prevent homelessness but it can help a substantial number of people remain housed by asking landlords to step up and alleviate some of the costs,”

Does Overregulation Help the Rental Housing Market?

 

Housing a basic human need (not a right), but the big question is does the willing overregulation of the rental housing market help keep more people housed? Or will it lead to factors that actually harm renters, and shrink the overall supply of quality housing?  

 

Many argue that it’s the lack of inventory (and regulation preventing swift building of more residential units) that is the real culprit. Long term regulation by local authorities has made it harder for Landlords to come to the market to invest in rental property due to the fear of inability to raise rents, inability to quickly remove negligent Tenants, and overall fear of being able to have control of their investment.

 

In the meantime, the San Diego City Council will be meeting to hear this new housing ordinance today and they may also meet again on May 15th for a second review.

 

If approved, the new housing ordinance will go into effect 30 days after it’s signed by the Mayor.
